Terms of Service

By creating an account, accessing, or using Pernity ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms and conditions, you may not access or use the Service.

1.1 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us if you suspect unauthorized access to your account.

2.1 Service Overview

Pernity provides AI-powered market analysis tools that help entrepreneurs and businesses validate app and business ideas. The Service includes: keyword extraction from business ideas, competitor discovery from public app store listings, collection and analysis of publicly available user reviews, AI-generated market insights and recommendations, and downloadable PDF reports (paid plans).

2.2 Data Sources

Our analysis relies on publicly available data from Apple App Store, Google Play Store, and web search results. We analyze app listings, descriptions, ratings, and user reviews that are publicly accessible.

2.3 Service Availability

We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, third-party API limitations, or circumstances beyond our control.

3.1 AI Processing

When you submit a business idea for analysis, we process it using AI language models provided by Google (Gemini) and OpenAI. Only the text content of your business idea is sent to these AI providers. Your personal information is NOT included in AI requests.

3.2 Third-Party Review Data

Our Service aggregates and analyzes publicly available user reviews from app stores. These reviews were written by third-party users and are their opinions, not ours. The sentiment analysis and theme extraction from reviews are AI interpretations.

3.3 Competitor Information

Competitor data (names, descriptions, ratings) is collected from public app store listings. The characterization of competitors as 'direct,' 'indirect,' or 'adjacent' is an AI-generated assessment.

3.4 Score Methodology

Market viability scores are generated by AI based on available data. These scores are subjective assessments, not objective measurements. Different analyses of the same idea may produce slightly different scores.

4.1 Permitted Use

You may use Pernity for legitimate business research, market analysis, and idea validation purposes. You may share your analysis results with your team, investors, or advisors.

4.2 Prohibited Activities

You agree NOT to: (a) use the Service for any illegal purpose; (b) attempt to gain unauthorized access to our systems or other accounts; (c) interfere with or disrupt the Service; (d) reverse engineer or attempt to extract source code; (e) use automated systems (bots, scrapers) to access the Service beyond normal usage; (f) resell or redistribute our analyses as a competing service; (g) submit false or misleading content.

4.3 Rate Limits

Your plan includes a specific number of analyses per month. Attempts to circumvent rate limits may result in account suspension.

5.1 Plans & Pricing

Pernity offers Free, Starter ($9.90/month), and Pro ($29.90/month) subscription plans. Current pricing and feature details are displayed on our pricing page. We reserve the right to modify pricing with advance notice to existing subscribers.

5.2 Billing

Paid subscriptions are billed in advance on a monthly basis through LemonSqueezy, our payment processor. By subscribing, you authorize LemonSqueezy to charge your payment method for recurring subscription fees.

5.3 Usage Limits

Each plan includes a specific number of analyses per month: Free (2 analyses), Starter (15 analyses), Pro (50 analyses). Unused analyses do NOT roll over to the next billing period. Usage resets on your billing date each month.

5.4 No Refunds

Due to the nature of our AI-powered digital service and the computational costs incurred upon analysis execution, all subscription fees are non-refundable. Please use the Free plan to evaluate the service before subscribing to a paid plan.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation: (a) you retain access to paid features until the end of your current billing period; (b) your account reverts to the Free plan after the billing period ends; (c) your existing analyses and projects remain accessible.

6.1 Our Intellectual Property

The Pernity Service, including its software, website design, and logos is owned by Pernity and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.

6.2 Your Content

You retain full ownership of the business ideas and project descriptions you submit to Pernity. By submitting content, you grant us a limited license to process and analyze your content solely for providing the Service to you. We do not claim ownership of your ideas.

6.3 Generated Analyses

The analyses and reports generated by Pernity are licensed to you for your personal or internal business use. You may share reports with your team, advisors, and investors. You may NOT resell our analyses as a standalone product.

6.4 Third-Party Content

App store data, reviews, and competitor information displayed in our analyses belong to their respective owners (Apple, Google, app developers, review authors). We display this public information for analytical purposes.

7.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7.2 No Business Advice

PERNITY IS NOT A SUBSTITUTE FOR PROFESSIONAL BUSINESS, LEGAL, FINANCIAL, OR INVESTMENT ADVICE. Our analyses are informational tools only. We are not responsible for business decisions you make based on our Service.

7.3 Third-Party Data

We do not guarantee the accuracy or completeness of data from third-party sources (app stores, web searches). Third-party data may be outdated or incorrect.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERNITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8.1 Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8.2 Data Deletion

You can delete individual projects at any time from your dashboard. To delete your entire account, use the account deletion feature in settings. When you delete your account, all your data is immediately and permanently removed from our systems.

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately.

9.2 Termination by Us

We may suspend or terminate your account if you: (a) breach these Terms; (b) engage in prohibited activities; (c) fail to pay subscription fees.

9.3 Effect of Termination

Upon termination, your data is permanently deleted. Provisions that should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.

We may modify these Terms at any time. We will notify you of changes by posting the updated Terms on our website and updating the 'Last Updated' date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11.1 Informal Resolution

Before initiating any formal dispute, please contact us and attempt to resolve any issue informally.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws.
